By accessing this website, requesting a quote, scheduling a job, renting a trailer, or otherwise using our services, you agree to these Terms of Use. If you do not agree, do not use this website or services.
2. Company Identity and Service Areas
GreenPath Junk Removal provides junk removal, hauling, and dump trailer rental services in and around Katy, West Houston, Cypress, Sugar Land, Richmond, Rosenberg, Fulshear, and nearby Texas communities. Service availability, pricing, and timelines may vary by location, property type, access constraints, weather, and disposal facility operating conditions.
3. Eligibility and Authority
You represent that you are at least 18 years old and have authority to authorize service at the property address provided. If you request service on behalf of a company, HOA, landlord, tenant, or other party, you represent that you have authority to bind that party.
4. Estimates, Quotes, and Scope
Quotes provided online, by phone, by text, or by email are non-binding estimates unless expressly stated as a final fixed quote in writing. Final pricing may be adjusted for volume, weight, material type, loading difficulty, stairs, distance to load point, restricted access, safety hazards, waiting time, overfill, prohibited items, and disposal surcharges. Scope changes requested at the job site may require revised approval before work continues.
5. Scheduling, Access, and Customer Responsibilities
You are responsible for ensuring lawful site access, clear pathways, and safe working conditions at the time of service. Gates, lockboxes, codes, pet containment, parking restrictions, HOA rules, elevator reservations, and utility markings are your responsibility unless otherwise agreed in writing. Missed appointments, denied access, or unsafe conditions may result in trip fees or cancellation charges.
6. Prohibited and Restricted Materials
Unless expressly approved in writing, you may not place or request removal of hazardous, toxic, medical, explosive, radioactive, corrosive, or otherwise regulated materials, including but not limited to asbestos-containing materials, wet paint, chemicals, solvents, oils, fuels, pesticides, biohazards, ammunition, propane cylinders, and batteries requiring special handling. You remain solely responsible for legal classification and disclosure of all materials presented for removal or disposal.
7. Dump Trailer Rental Terms
Trailer rental periods, weight limits, load height limits, and placement requirements are defined in your rental confirmation. Loads must remain level with trailer sides unless explicit overage authorization is provided in writing. You are responsible for secure, legal loading and for preventing unauthorized use while trailer is in your custody. You are liable for trailer damage occurring during your custody period, including damage from overloading, improper loading, towing misuse, prohibited materials, vandalism, theft, fire, or impact events, except to the extent caused solely by our gross negligence or willful misconduct. Additional fees may apply for overages, prohibited materials, relocation requests, blocked pickup access, extended rental periods, repairs, replacement parts, cleaning, loss-of-use, and recovery costs.
8. Ownership and Right to Dispose
By presenting items for removal, you represent that you own the items or are authorized to transfer possession and disposal rights. Once removed from site, title to accepted materials transfers to GreenPath Junk Removal to the extent permitted by law, and items may be disposed, recycled, donated, or otherwise handled at our discretion.
9. Payment Terms
Payment is due upon completion of service unless a different term is approved in writing. Accepted methods may include card, ACH, cash, or other methods listed at booking. You authorize us and our payment processors to charge approved amounts, including approved scope adjustments and applicable taxes and fees. Late balances may accrue lawful collection costs, interest, and third-party recovery expenses to the extent permitted by law.
10. Cancellations and Refunds
Cancellation windows and any applicable fees depend on service type and booking lead time. Same-day cancellations, no-show appointments, and blocked access may incur charges. Refunds, if any, are issued at our discretion based on verified service records, photos, dispatch logs, and payment data. Disposal costs already incurred are generally non-refundable.
11. Property Conditions, Damage Claims, and Hold Harmless
You are responsible for disclosing known site conditions, including weak pavement, concealed irrigation lines, septic systems, low-clearance structures, and other hazards. We use commercially reasonable care during loading and trailer placement. Any damage claim must be reported in writing within 48 hours of service completion with photos and supporting details. Failure to provide timely notice limits our ability to investigate and may result in denial of the claim to the maximum extent permitted by law. Except to the extent directly caused by our gross negligence or willful misconduct, you agree to release, defend, indemnify, and hold harmless GreenPath Junk Removal from claims for property damage arising from undisclosed hazards, inadequate access, unstable surfaces, third-party conduct, weather, acts of God, or your instructions regarding placement, loading sequence, access route, or item handling.
12. Warranties and Service Standards
Services are provided on an "as is" and "as available" basis to the fullest extent permitted by law. We disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted availability of scheduling tools, quote forms, mapping tools, third-party payment systems, or communications networks.
13. Limitation of Liability
To the maximum extent permitted by law, GreenPath Junk Removal and its owners, officers, employees, contractors, and affiliates are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, business interruption, or data loss. Our aggregate liability for any claim arising from a specific service event will not exceed the amount you paid for that event.
14. Indemnification and Unintended Item Removal
You agree to defend, indemnify, and hold harmless GreenPath Junk Removal and its affiliates from claims, penalties, fines, costs, and legal fees arising from your breach of these Terms, your unlawful materials, inaccurate representations, unsafe site conditions under your control, or instructions given by you or your representatives.
You are solely responsible for clearly identifying items that must not be removed before service begins. If items are co-mingled, unlabeled, inaccessible for verification, or represented by you as approved for removal, you assume all risk of unintended removal. To the fullest extent permitted by law, you release and hold harmless GreenPath Junk Removal from claims related to removal of items not intended for removal when such removal is based on your instructions, site markings, staging, or failure to segregate protected items. Any claim of unintended removal must be submitted in writing within 24 hours of service completion and include a specific item list and proof of ownership. Our sole obligation, if liability is established, is limited to the lesser of fair market value of the item at time of removal or the amount paid for the related service event, and we are not liable for sentimental, speculative, replacement-premium, consequential, or punitive damages.
15. Communications Consent
By submitting contact information, you consent to service-related communications by phone, text message, and email, including appointment reminders, dispatch updates, and follow-up requests. Message and data rates may apply. Marketing communications are optional and can be withdrawn using provided opt-out methods.
16. Intellectual Property
All website content, including text, logos, design elements, images, and branding, is owned by or licensed to GreenPath Junk Removal and protected by applicable intellectual property laws. You may not reproduce, republish, scrape, modify, or commercially exploit site content without prior written permission.
17. Third-Party Services and Links
Our website may use or link to third-party tools, including mapping, analytics, captcha, payment, and hosting providers. We are not responsible for third-party content, uptime, security, or policy changes. Your use of those services is subject to their own terms and privacy policies.
18. Force Majeure
We are not liable for delays or non-performance caused by events beyond reasonable control, including severe weather, flooding, road closures, labor disruptions, public utility interruptions, disposal facility closures, regulatory actions, or public emergencies.
19. Governing Law and Venue
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any dispute not resolved informally will be brought exclusively in state or federal courts located in Harris County or Fort Bend County, Texas, and you consent to personal jurisdiction in those courts.
20. Changes to These Terms
We may revise these Terms at any time by posting updates to this page. Updated terms become effective on the posted "Last Updated" date unless stated otherwise. Continued use of the site or services after updates constitutes acceptance of revised Terms.
